Vetoomus Murad Gasaevin puolesta

Tshetsheeni Murad Gasaev on luovutettu Espanjasta Venäjän Federaatiolle 31.12.2008. Tällä hetkellä Gasaev odottaa Moskovassa siirtoa esitutkintakeskukseen Pohjois-Kaukasukseen. Gasaevia syytetään osallistumisesta terroristihyökkäykseen vuonna 2004, todisteet hänen osallisuudestaan ovat hataria. Murad Gasaev on vaarassa tulla kidutetuksi kuulusteluiden aikana. On myös mahdollista, että hänet tuomitaan vankeuteen epäoikeudenmukaisessa oikeudenkäynnissä.

Lähetä vetoomus alla oleviin osoitteisiin, jotta Gasaeville suotaisiin mahdollisuus oikeudenmukaiseen oikeudenkäyntiin, mahdollisuus itse valitsemaansa lakimieheen, oikeuteen tavata perheenjäseniään sekä mahdollisuus saada tarvitsemiaan lääkkeitä vankeutensa aikana.

Ethnic Chechen Murad Akhmedovich Gasaev, who is a Russian citizen, was extradited to Russia by the Spanish authorities on 31 December. He is now in a detention facility in Moscow, but is soon to be
transferred to a pre-trial detention centre in the North Caucasus region of southern Russia. Murad Gasaev is at risk of being subjected to torture and other ill-treatment, and is likely to receive an unfair trial.

According to the Russian authorities, Murad Gasaev is a member of an armed group named Khalifat and “took part in several terrorist attacks against representatives of the state and law enforcement officers in the North Caucasus,” including a June 2004 armed attack on a Ministry of the Interior building in the capital of the Republic of Ingushetia, Nazran.

Murad Gasaev has alleged that in August 2004 he was tortured and questioned by officials of the central office of the Federal Security Service in Ingushetia about the June 2004 attack. After three days of
torture he was taken in a van and released in open country.

Amnesty International and other human rights organizations working in the region have researched many cases over recent years where individuals, in particular ethnic Chechen and Ingush men, have been
charged with and convicted of terrorism-related offences, based on forced confessions and other testimony extracted under torture. The organization has concluded that an individual accused of acts of terrorism may not receive a fair trial in Russia and could be at risk of being subjected to torture and other ill-treatment.

Глубокоуважаемый господин Президент,

Пишу Вам, чтобы выразить свою глубокую тревогу о экстрадиции уроженца Чечни Мурада Гасаева. Гасаева выдали из Испании российским властям 31 декабря 2008г. В российской тюрме ему угражают пытки и жестокое обращение со стороны правоохранительных органов Российской Федерации.

Я обращаюсь к вам, глубокоуважаемый представитель законодательной и исполнительной власти Российской Федерации, чтобы напомнить, что властей обязывают международные и российские законы, согласно которым, задержанные не должны быть подвергаться пыткам и жестоким обращением. Также хочу подчеркнуть что при задержки Мурада Гасаева, его должна касаться полная защита российского и международного закона, что включает в себя немедленный доступ к юристу по его выбору, доступ к его семье и ему надобной медицине.

Я также прошу властей Российской Федерации о справедливом судебном разбирательстве в соответсвии международным стандартам, если Мурада Гасаева будут обвинять в криминальном поступке.

Dear Mr President

I am writing to you to express my concern about extradition of Murad Gasaev on 31 December, 2008. Murad Gasaev is an enthnic Chechen who was extradited from Spain to Russia, where might be subjected to torture and other ill-treatment by law enforcement officers while in detention.

Please, be respectfully reminded, that authorities are obliged by international and Russian law to ensure that detainees are not tortured or otherwise ill-treated. I also would like to point out that Murad Gasaev should be accorded full protection of Russian and international law when in detention, including immediate access to a lawyer of his choice, access to his family and any medical attention he may require.

I also urge the Federal authorities that if Murad Gasaev is charged with a recognizable criminal offence, he should be tried in proceedings that meet internationally recognized standards of fair trial.
